What happens after the Court of Appeal decision?

After the Court of Appeal issues its decision, the losing party may file a Petition for Rehearing. Such petitions are rarely granted.

The losing party may also file a Petition for Review with the California Supreme Court, or a Petition for Certiori with the U.S. Supreme Court. These petitions ask the respective Supreme Court to take up the case. The Supreme Courts rarely grant such petitions. Your appellate attorney will advise you whether your case involves issues that a Supreme Court might be inclined to review.

Once the Decision becomes final, the Court of Appeal files with the trial court a document called a Remittitur, which formally returns the case back to the trial court.
