Q:
What are the powers of the Court of Appeal?

A:

The Court of Appeal can affirm, reverse, or modify the trial court's judgment or order. If the Court of Appeal affirms, it upholds the decision of the trial judge or jury, and the judgment or order becomes final. Sometimes the Court of Appeal will affirm only a portion of the judgment, but reverse or modify another portion.

If the Court of Appeal reverses a judgment or order, it is annulled. The case usually returns to the trial court for reconsideration or a new trial.

Sometimes the Court of Appeal will modify the judgment or order. The modified judgment or order then becomes final; there are no further trial court proceedings on these matters.
